{"id":939,"date":"2011-04-15T08:13:40","date_gmt":"2011-04-15T08:13:40","guid":{"rendered":"http:\/\/mauritiustimes.com\/mt\/2011\/04\/15\/vina-ballgobin-16\/"},"modified":"2020-03-23T10:14:45","modified_gmt":"2020-03-23T06:14:45","slug":"vina-ballgobin-16","status":"publish","type":"post","link":"https:\/\/www.mauritiustimes.com\/mt\/vina-ballgobin-16\/","title":{"rendered":"Fight against corruption &#8211; The second struggle for independence\u00a0"},"content":{"rendered":"<p style=\"text-align: center;\"><span style=\"color: #000000;\"><u>Anna Hazare<\/u><\/span><!--more--><\/p>\n<p><strong><span style=\"color: #000080;\">By Vina Ballgobin<\/span><\/strong><\/p>\n<p><span style=\"color: #000000;\"><em><strong>The dream of India as a strong nation will not be realized without self-reliant, self-sufficient villages, this can be achieved only through social commitment &amp; involvement of the common man. <\/strong><\/em><\/span><\/p>\n<p style=\"text-align: right;\"><span style=\"color: #000000;\"><strong>&#8212; Anna Hazare<\/strong><\/span><\/p>\n<p><span style=\"color: #000000;\">Anna Hazare a eu une reconnaissance internationale ces derniers jours gr\u00e2ce \u00e0 son action inattendue et impr\u00e9visible\u00a0: \u00e0 70 ans, il a entam\u00e9 une gr\u00e8ve de la faim \u00e0 New Delhi pour r\u00e9clamer la mise sur pied d\u2019un comit\u00e9 avec un encadrement l\u00e9gal strict, le <em>Jan Lokpal Bill<\/em>, dans le cadre de la lutte contre la corruption. 150 personnes ont je\u00fbn\u00e9 avec lui tous les jours\u00a0et plusieurs autres citoyens ont entam\u00e9 une gr\u00e8ve de la faim \u00e0 ses c\u00f4t\u00e9s; les politiciens n\u2019avaient pas le droit de faire partie du mouvement citoyen. Anna Hazare est imm\u00e9diatement soutenu par des milliers de partisans en Inde et dans la diaspora indienne \u00e0 travers le monde. Plusieurs personnes se d\u00e9placent pour le rencontrer \u00e0 New Delhi en signe de protestation contre les scandales politiques associ\u00e9s \u00e0 la corruption. Il est soutenu par des patriotes tels que l\u2019acteur-r\u00e9alisateur Aamir Khan, le sportif Kapil Dev et des milliers d\u2019autres citoyens ordinaires indiens.<\/span><\/p>\n<p><span style=\"color: #000000;\">Ce <em>Bill<\/em> permettrait de juger de mani\u00e8re impartiale tout pr\u00e9sum\u00e9 coupable de corruption, peu importe son statut social, professionnel ou politique dans la soci\u00e9t\u00e9 indienne. Le comit\u00e9 anti-corruption devrait pouvoir interroger tout citoyen indien sans distinction aucune. Le comit\u00e9 r\u00e9dactionnel devrait, selon Anna Hazare, \u00eatre compos\u00e9 de membres de la mani\u00e8re suivante\u00a0: 50% du gouvernement et 50% de la soci\u00e9t\u00e9 civile, incluant citoyens ordinaires et Prix Nobel d\u2019origine indienne. Les actions p\u00e9nales devraient \u00eatre plus dures envers les corrompus et le comit\u00e9 travaillerait en toute ind\u00e9pendance.<\/span><\/p>\n<p><span style=\"color: #000000;\">Dans la foul\u00e9e, Anna Hazare et ses partisans ont d\u00e9nonc\u00e9 le syst\u00e8me de travail du gouvernement que l\u2019on pourrait qualifier comme \u00e9tant de la \u00ab\u00a0poudre aux yeux\u00a0\u00bb. La premi\u00e8re proposition du gouvernement &#8212; le Pr\u00e9sident d\u2019un nouveau comit\u00e9 informel charg\u00e9 de la lutte contre la corruption serait le ministre des Finances, Pranab Mukherjee &#8211;, est rejet\u00e9e \u00e0 l\u2019unanimit\u00e9. Ensuite, le retrait de certains politiciens, formant partie du comit\u00e9 actuel (charg\u00e9 de la lutte contre la corruption), comme le ministre de l&#8217;Agriculture Sharad Pawar est exig\u00e9. Le mouvement est clair\u00a0: il faut un d\u00e9cret &#8212; et vite &#8212; car les Indiens l\u2019attendent depuis 1968. Il n\u2019est pas question d\u2019attendre une neuvi\u00e8me version qui ne sera pas adopt\u00e9e au parlement non plus afin de favoriser de puissants lobbys, des politiciens corrompus, des \u2018roder-boute\u2019 et autres parasites de la soci\u00e9t\u00e9.<\/span><\/p>\n<p><span style=\"color: #000000;\">Dans cette tr\u00e8s grande d\u00e9mocratie, le gouvernement indien s\u2019est inclin\u00e9 face au verdict populaire. Le 9 avril 2011, apr\u00e8s 98 heures de gr\u00e8ve de la faim de Anna Hazare et de plusieurs de ses partisans, il a agr\u00e9\u00e9 \u00e0 toutes leurs demandes, avec comme preuve une notice de la <em>Government Gazette <\/em>de la cr\u00e9ation d\u2019un comit\u00e9 mixte avec une composante importante de la soci\u00e9t\u00e9 civile, tri\u00e9e sur le volet. Le Pr\u00e9sident sera un politicien (Pranab Mukherjee) mais il y aura aussi un co-Pr\u00e9sident &#8212; un citoyen activiste ne faisant pas partie de la classe politique (Shanti Bhushan).<\/span><\/p>\n<p><span style=\"color: #000000;\">\u201cThe Joint Drafting Committee shall consist of five nominee ministers of the Government of India and five nominees of the civil society. The five nominee Ministers of the Government of India are Pranab Mukherjee, Union Minister of Finance, P. Chidambaram, Union Minister of Home Affairs, M.Veerappa Moily, Union Minister of Law and Justice, Kapil Sibal, Union Minister of Human Resource and Development and Minister of Communication and Information Technology and Salman Khursheed, Union Minister of Water Resources and Minister of Minority Affairs. The five nominees of the civil society are Anna Hazare, N. Santosh Hadge, Shanti Bhushan Senior Advocate, Prashant Bhushan, Advocate and Arvind Kejriwal.\u201d<\/span><\/p>\n<p><span style=\"color: #000000;\">Anna Hazare fait partie de l\u2019\u00e2me profonde de son pays. Il refuse toute all\u00e9geance politique. Par son action, il rend hommage \u00e0 tous ceux qui se sont battus pour l\u2019ind\u00e9pendance de l\u2019Inde et qui \u0153uvrent en silence pour son avancement sur tous les plans. Il porte en lui la flamme de l\u2019ind\u00e9pendance &#8212; la vraie &#8212; qui n\u2019attend que le meilleur pour l\u2019Inde, les citoyens indiens, la nation indienne. Ce n\u2019est pas \u00e9tonnant que les manifestants soient issus de diverses r\u00e9gions, jeunes et vieux chantant leur hymne national et agitant le drapeau national indien autour de Anna Hazare \u00e0 New Delhi.<\/span><\/p>\n<p><span style=\"color: #000000;\">L\u2019\u00e9quipe de Anna Hazare est r\u00e9aliste. Ils se donnent jusqu\u2019au 15 ao\u00fbt 2011 pour pr\u00e9parer et passer le <em>Jan Lokpal Bill <\/em>au Parlement indien. C\u2019est le d\u00e9but d\u2019une longue qu\u00eate pour transformer le pays et le mener vers un changement profond de mentalit\u00e9, vers l\u2019\u00e9radication de la devise invent\u00e9e par les \u2018roder-boute\u2019 &#8212; \u00ab\u00a0coume sa meme sa, pas capav fer nanrien\u00a0\u00bb. C\u2019est une guerre diff\u00e9rente, plus difficile et sem\u00e9e d\u2019emb\u00fbches\u00a0: c\u2019est la guerre contre l\u2019ignorance des valeurs fondamentales immuables et contre la m\u00e9diocrit\u00e9 sous toutes ses formes. Toutefois, la jeunesse indienne avec l\u2019aide d\u2019un visionnaire \u00e9clair\u00e9 de 71 ans, a prouv\u00e9 qu\u2019elle peut se mobiliser de mani\u00e8re pacifique, sans utiliser des m\u00e9thodes viles et contestables, sans mettre en p\u00e9ril la s\u00e9curit\u00e9 et la paix du pays, pour d\u00e9fendre une cause nationale d\u2019envergure.<strong>\u00a0<\/strong><\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"color: #000000;\"><strong>Anne Hazare\u00a0: Un citoyen ordinaire <\/strong><\/span><\/p>\n<p><span style=\"color: #000000;\">Anna Hazare ou Kisan Baburao Hazare est n\u00e9 le 15 janvier 1940 \u00e0 Bhingar au Maharashtra. Son p\u00e8re est ouvrier tandis que son grand-p\u00e8re travaille pour l\u2019arm\u00e9e indienne. A l\u2019\u00e2ge de cinq ans, sa famille d\u00e9m\u00e9nage pour habiter au village natal, Ralegan Siddhi. La vie est dure pour cette famille de la classe ouvri\u00e8re avec six enfants. Quelque temps plus tard, Anna Hazare est adopt\u00e9 par sa tante et il part pour Bombay avec elle. Apr\u00e8s quelques ann\u00e9es d\u2019\u00e9tudes, il devient fleuriste et aide sa famille sur le plan financier. S\u00e9rieux, travailleur et innovateur, il finit par ouvrir un magasin de fleurs et demande \u00e0 deux de ses fr\u00e8res de le rejoindre. La vie devient plus facile sur le plan \u00e9conomique.<\/span><\/p>\n<p><span style=\"color: #000000;\">Anna Hazare souhaite suivre les pas de son grand-p\u00e8re et il int\u00e8gre l\u2019arm\u00e9e indienne en tant que chauffeur \u00e0 l\u2019\u00e2ge de 23 ans. En outre, il est un fervent admirateur des patriotes indiens tels que Gandhi et il conna\u00eet leur histoire et leur parcours par c\u0153ur. Il est marqu\u00e9 lui-m\u00eame par quelques \u00e9v\u00e8nements\u00a0: il est l\u2019unique survivant de son \u00e9quipe lors d\u2019une guerre indo-pakistanaise en 1965 et il est sauv\u00e9 in extremis d\u2019un accident en 1970. En 1975, lorsqu\u2019il prend sa retraite de l\u2019arm\u00e9e, il regagne le village Ralegan Siddhi\u00a0pour vivre aupr\u00e8s de sa famille<\/span><\/p>\n<p><span style=\"color: #000000;\">A partir de l\u00e0, Anna Hazarre \u0153uvre pour le d\u00e9veloppement du village Ralegan Siddhi et sa transformation en un village mod\u00e8le du Maharashtra. Il organise les jeunes du village au sein d\u2019une association, le <em>Tarun Mandal. <\/em>Avec eux, Anna Hazare m\u00e8ne plusieurs r\u00e9unions au temple du village avec les villageois pour les sensibiliser \u00e0 propos du fl\u00e9au de l\u2019alcoolisme. Une r\u00e9solution est adopt\u00e9e \u00e0 l\u2019int\u00e9rieur du temple\u00a0: l\u2019alcool sera d\u00e9sormais banni du village. Plusieurs fabricants d\u2019alcool ferment leur petite entreprise volontairement et d\u2019autres sont oblig\u00e9s de se plier \u00e0 cette d\u00e9cision collective sous la pression des jeunes qui d\u00e9truisent toutes les fabriques ill\u00e9gales. Malheureusement, certains villageois se procurent les boissons alcoolis\u00e9es du village voisin. Le <em>Tarun Mandal<\/em> prend cette d\u00e9cision\u00a0: ils re\u00e7oivent trois avertissements et s\u2019ils n\u2019arr\u00eatent pas leurs mauvaises habitudes, ils seront sanctionn\u00e9s par le tribunal du village. Ainsi, douze villageois ivrognes sont attach\u00e9s \u00e0 un poteau et ils re\u00e7oivent des coups de fouet en guise de punition.<\/span><\/p>\n<p><span style=\"color: #000000;\">Ensuite, Anna Hazare effectue une demande aupr\u00e8s des autorit\u00e9s du Maharashtra\u00a0: si, apr\u00e8s une \u00e9lection (vote par bulletin secret), 25% des femmes du village sont en faveur de l\u2019interdiction d\u2019alcool au village et elles envoient ces r\u00e9sultats par \u00e9crit au <em>State Excise Department<\/em>, les autorit\u00e9s doivent obligatoirement appliquer cette r\u00e9solution. Si 50% des femmes votent contre la vente d\u2019alcool au village, les autorit\u00e9s doivent appliquer cette d\u00e9cision \u00e0 la lettre en fermant tous les points de vente. En juillet 2009, le <em>Bombay Prohibition Act<\/em> <em>1949<\/em> est amend\u00e9 : la vente de boissons alcoolis\u00e9es d\u00e9pend d\u00e9sormais du <em>Gram Sabha <\/em>(mouvement citoyen). Bien entendu, il y a ceux qui poursuivent les femmes en justice\u00a0: Anna Hazare les d\u00e9fend et il obtient gain de cause. Face \u00e0 leur succ\u00e8s, les jeunes du village d\u00e9cident d\u2019interdire la vente de tabac, de cigarettes et de \u00ab\u00a0beeries\u00a0\u00bb (une cigarette indienne). Lors de la c\u00e9r\u00e9monie de Holi, un grand feu est allum\u00e9 et tous ces objets sont br\u00fbl\u00e9s de mani\u00e8re symbolique. Depuis, aucun magasin du village ne vend ces produits.<\/span><\/p>\n<p><span style=\"color: #000000;\">Anna Hazare s\u2019occupe de rendre plus efficace la distribution de l\u2019eau au village en mettant sur pied les associations de distribution d\u2019eau, les<em> Pani Puravatha Mandals<\/em>. Les villageois font du <em>shramdan<\/em> &#8212; du travail volontaire &#8212; et ils construisent des canaux et un r\u00e9seau de distribution et de stockage d\u2019eau. Devant la motivation des villageois, le gouvernement finance la construction d\u2019un r\u00e9servoir d\u2019eau et depuis le syst\u00e8me agricole se d\u00e9veloppe de mani\u00e8re durable. Anna Hazare ne s\u2019arr\u00eate pas en si bon chemin\u00a0: il s\u2019attaque au probl\u00e8me de l\u2019\u00e9rosion. Des tranch\u00e9es sont construites et des plantes vertes sont plant\u00e9es autour des zones montagneuses. Le syst\u00e8me de goutte-\u00e0-goutte est impl\u00e9ment\u00e9 afin de tendre vers une utilisation efficace de cette pr\u00e9cieuse ressource. Ce <em>Watershed Development Programme<\/em> aide au d\u00e9veloppement d\u2019un village agricole prosp\u00e8re sur une superficie de 320,000 m2.<\/span><\/p>\n<p><span style=\"color: #000000;\">Anna Hazare s\u2019occupe ensuite de la production de lait au village. Le succ\u00e8s est retentissant\u00a0: l\u2019on passe de la production de 100 litres de lait par jour \u00e0 2,500 litres quotidiennement. Une soci\u00e9t\u00e9 coop\u00e9rative, le Malganga Dairy, s\u2019occupe de cette entreprise. Le village offre m\u00eame du lait b\u00e9n\u00e9volement \u00e0 une \u00e9cole maternelle pour assurer le programme de nutrition des enfants. Les producteurs vendent leurs produits &#8212; fruits, l\u00e9gumes et lait &#8212; directement sur le march\u00e9 sans interm\u00e9diaire.<\/span><\/p>\n<p><span style=\"color: #000000;\">Depuis, plus de 70 villages suivent le programme de Anna Hazare et les agriculteurs se sp\u00e9cialisent dans l\u2019agriculture durable. Le gouvernement a d\u00e9cid\u00e9 d\u2019ouvrir un centre de formation au village Ralegan Siddhi afin d\u2019\u00e9tudier les principes \u00e9labor\u00e9s par Anna Hazare et transf\u00e9rer ce mod\u00e8le de d\u00e9veloppement durable dans d\u2019autres villages du pays. Comme quoi, il ne faut pas forc\u00e9ment suivre des cours universitaires pour concurrencer l\u2019\u00e9lite acad\u00e9mique\u00a0!<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"color: #000000;\"><strong>Prix obtenus<\/strong><\/span><\/p>\n<p><span style=\"color: #000000;\">Anna Hazare est le r\u00e9cipiendaire de nombreux prix en Inde (Indira Priyadarshini Vrikshamitra Award, Padma Bhushan Award, Rabindranath Tagore International Peace Prize, etc) et de la Banque mondiale (Jit Gill Memorial Award) en reconnaissance de son travail pour le d\u00e9veloppement durable, l\u2019\u00e9cologie et la lutte contre la corruption.<\/span><\/p>\n<p><span style=\"color: #000000;\">(Pour plus de details sur ce bill, veuillez consulter le site suivant : http:\/\/indiaagainstcorruption.org\/. N\u2019h\u00e9sitez pas \u00e0 vous enregistrer pour soutenir le mouvement de Anna Hazare et participer en tant que citoyen du monde contre la corruption)<em><strong>\u00a0<\/strong><\/em><\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"color: #000000;\"><strong><u>Jan Lokpal Bill draft version 2.1<\/u><\/strong><\/span><\/p>\n<ol start=\"2\">\n<li><span style=\"color: #000000;\"><strong> Definitions:-<\/strong> In this Act, unless the context otherwise requires,-<\/span><\/li>\n<\/ol>\n<p><span style=\"color: #000000;\">(1)\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 \u201cAction\u201d means any action taken by a public servant in the discharge of his functions as such public servant and includes decision, recommendation or finding or in any other manner and includes willful failure or omission to act and all other expressions relating to such action shall be construed accordingly;<\/span><\/p>\n<p><span style=\"color: #000000;\">(2)\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 \u201cAllegation\u201d in relation to a public servant includes any affirmation that such public servant-<\/span><\/p>\n<p><span style=\"color: #000000;\">(a)\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 has indulged in misconduct, if he is a government servant;<\/span><\/p>\n<p><span style=\"color: #000000;\">(b)\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 has indulged in corruption<\/span><\/p>\n<p><span style=\"color: #000000;\">(3)\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 \u201ccomplaint\u201d includes any grievance or allegation or a request by whistleblower for protection and appropriate action.<\/span><\/p>\n<p><span style=\"color: #000000;\">(4)\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 \u201ccorruption\u201d includes anything made punishable under Chapter IX of the Indian Penal Code or under the Prevention of Corruption Act, 1988;<\/span><\/p>\n<p><span style=\"color: #000000;\">Provided that if any person obtains any benefit from the government by violating any laws or rules, that person along with the public servants who directly or indirectly helped that person obtain those benefits, shall be deemed to have indulged in corruption.<\/span><\/p>\n<p><span style=\"color: #000000;\">(5)\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 \u201cGovernment\u201d or \u201cCentral Government\u201d means Government of India.<\/span><\/p>\n<p><span style=\"color: #000000;\">(6)\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 \u201cGovernment Servant\u201d means any person who is or was any time appointed to a civil service or post in connection with the affairs of the Central Government or High Courts or Supreme Court either on deputation or permanent or temporary or on contractual employment but would not include the judges.<\/span><\/p>\n<p><span style=\"color: #000000;\">(7)\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 \u201cgrievance\u201d means a claim by a person that he sustained injustice or undue hardship in consequence of mal-administration;\u00a0\u00a0<\/span><\/p>\n<ol start=\"16\">\n<li><span style=\"color: #000000;\"><strong> Matters which may be investigated by the Lokpal \u2013 <\/strong>Subject to the provisions of this Act, the Lokpal may investigate any action which is taken by or with the general or specific approval of a public servant where a complaint involving a grievance or an allegation is made in respect of such action.<\/span><\/li>\n<\/ol>\n<p><span style=\"color: #000000;\">Provided that the Lokpal may also investigate such action suo moto or if it is referred to it by the government, if such action can be or could have been in his recorded opinion, subject of a grievance or an allegation.<\/span><\/p>\n<ol start=\"19\">\n<li><span style=\"color: #000000;\"><strong> Recovery of loss to the Government: <\/strong>When a person is convicted of an offence under the Prevention of Corruption Act 1988, then the trial court shall quantify the loss caused to the government and apportion that amount to various convicts from whom this money must be recovered as arrears of land revenue.<\/span><\/li>\n<\/ol>\n<p><span style=\"color: #000000;\"><strong>19 A. Punishments for offences: <\/strong>For offences mentioned in Chapter III of the Prevention of Corruption Act, the proviso to section 2(4) of this Act and section 28A of this Act, the punishment shall not be less than two years of rigorous imprisonment and may extend upto life imprisonment.<\/span><\/p>\n<p><span style=\"color: #000000;\">Provided that if the accused is an officer of the rank of Joint Secretary or above or a Minister, a member or Chairperson of the Lokpal, the punishment shall not be less than ten years of imprisonment.<\/span><\/p>\n<p><span style=\"color: #000000;\">Provided further that if the offence is of the nature mentioned in the proviso to section 2(4) of this Act and if the beneficiary is a business entity, in addition to other punishments mentioned in this Act and under the Prevention of Corruption Act, a fine amounting to five times the loss caused to the public shall be recovered from the accused and the recovery may be done from the assets of the business entity and from the personal assets of all its Directors, if the assets of the accused are inadequate.<\/span><\/p>\n<ol start=\"20\">\n<li><span style=\"color: #000000;\"><strong> Protection of Whistleblower:<\/strong> (1) A whistleblower may seek the protection of the Lokpal if he has been subjected to or threatened with, professional or physical victimization.<\/span><\/li>\n<\/ol>\n<p><span style=\"color: #000000;\">(2) On receiving such a complaint, Lokpal shall take following steps:<\/span><\/p>\n<p><span style=\"color: #000000;\">(a) Professional victimization: If after conducting appropriate enquiries, the Lokpal feels that there is a real threat to the whistleblower on account of having made an allegation under this Act, it shall, as soon as possible but not more than a month of receipt of such complaint, direct appropriate authorities to take such steps as directed by the Lokpal.<\/span><\/p>\n<p><span style=\"color: #000000;\">(b) If a whistleblower complains that he has been victimized professionally on account of making an allegation under this Act and the Lokpal, after conducting enquiries, is of the opinion that the whistleblower has been victimized for having made an allegation under this Act, it shall, as soon as possible but in not more than a month, direct appropriate authorities to take such steps as directed by the Lokpal.<\/span><\/p>\n<p><span style=\"color: #000000;\">\u00a0(d) If a person complains that he has already been physically assaulted on account of making an allegation under this Act and if Lokpal is satisfied after conducting enquiries that the person has been assaulted because of his having made an allegation under this Act or for filing an RTI application in any of the public authorities covered under this Act, then notwithstanding anything else contained in any other law, the Lokpal shall pass such orders, as soon as possible but in not more than 24 hours, directing the concerned authorities to take such steps as directed by the Lokpal to provide adequate security to that person, to register criminal cases and also to ensure that no further harm visits on that person.<\/span><\/p>\n<p><span style=\"color: #000000;\">(e) If the whistleblower has alleged an act punishable under Prevention of Corruption Act, then for cases under clause (c), Lokpal may and for cases under clause (d), the Lokpal shall, assign the allegations made by that person to a special team, put it on a fast track and complete investigations in that case in not more than a month.<\/span><\/p>\n<p><span style=\"color: #000000;\">(f) If the whistleblower has alleged an act punishable under any law other than the Prevention of Corruption Act, then for cases under clause (c), Lokpal may and for cases under clause (d), the Lokpal shall, direct the agency which has the powers to enforce that law to assign the allegations made by the whistleblower to a special team, put it on a fast track and complete investigations in that case in such time as directed by the Lokpal.<\/span><\/p>\n<p><span style=\"color: #000000;\">(g) Lokpal shall have the powers to issue directions to appropriate agencies in the cases covered under clause (f), monitor such investigations and if necessary, issue directions to that agency to do the investigations in the manner as directed by the Lokpal.<\/span><\/p>\n<p><span style=\"color: #000000;\">(h) Whistleblowers, who face threat of physical victimization or are actually assaulted may directly approach the Chairperson of Lokpal who shall meet them within 24 hours of their seeking such meeting and shall take appropriate action as per provisions of this Act.<\/span><\/p>\n<h4 style=\"text-align: center;\"><span style=\"color: #000000;\">Grievance Redressal Systems<\/span><\/h4>\n<ol start=\"21\">\n<li><span style=\"color: #000000;\"><strong> Citizens\u2019 Charters:<\/strong> (1) Each public authority shall be responsible for ensuring the preparation and implementation of Citizens Charter, within a reasonable time, and not exceeding one year from the coming into force of this Act.<\/span><\/li>\n<\/ol>\n<p><span style=\"color: #000000;\">\u00a0(2) Every Citizens Charter shall enumerate the commitments of the respective public authority to the citizens, officer responsible for meeting each such commitment and the time limit with in which the commitment shall be met.<\/span><\/p>\n<p><span style=\"color: #000000;\">(3) Each public authority shall designate an official called Public Grievance Redressal Officer, whom a complainant should approach for any violation of the Citizens Charter.<\/span><\/p>\n<p><span style=\"color: #000000;\">Provided that a public authority shall appoint at least one Public Grievance Redressal Officer in each station, where they have an office.<\/span><\/p>\n<p><span style=\"color: #000000;\">Provided further that the Public Grievance Redressal Officer shall either be Head of that Department or an officer not more than one rank below him but if that station does not have a Head of Department in any station, the seniormost officer in that station shall be appointed as the Public Grievance Redressal Officer.<\/span><\/p>\n<p><span style=\"color: #000000;\">(4) Every public authority shall review and revise its Citizens Charter at least once every year through a process of public consultation to be held in the presence of Chief Vigilance Officer in that public authority.<\/span><\/p>\n<p><span style=\"color: #000000;\">(5) Lokpal may direct any public authority to make such changes in their citizens\u2019 charter as are mentioned in that order and that public authority shall make such changes within a week of receipt of such order.<\/span><\/p>\n<p><span style=\"color: #000000;\">Provided that such changes shall have to be approved by at least a three member bench of Lokpal.<\/span><\/p>\n<p><span style=\"color: #000000;\">Provided further than such changes should not increase the existing time limits or reduce the number of items in citizen\u2019s charter.<\/span><\/p>\n<p><span style=\"color: #000000;\"><strong>31 B.
