Among them, three ministers and one junior minister have declared spending that exceeds the legal limit set by the Representation of the People Act. While some may see this as an attempt at openness, the law is clear &#8212; overspending constitutes an illegal practice that carries severe consequences, including fines and disqualification from voting or running for office.<\/strong><\/span><\/p>\n<p><span style=\"color: #000000;\"><strong>This controversy raises critical legal and political questions: Should the Electoral Commission or the Electoral Supervisory Commission take action, potentially referring the matter to the Supreme Court? Can the implicated MPs seek relief under Sections 74A and 74B of the Act, claiming inadvertence or good faith? And if the excess spending is minimal, should the Court exercise leniency, or would that undermine the credibility of electoral laws? Lex shares his legal perspective on the matter, shedding light on the potential consequences and broader implications of electoral finance violations.<\/strong><\/span><\/p>\n<p><span style=\"color: #000000;\"><strong>* Six newly elected MPs from the &#8216;Alliance du Changement,&#8217; including three ministers and one junior minister, have declared electoral expenses exceeding the legal limit in the last elections. While this may reflect an attempt at transparency, whether intentional or not, it remains a serious violation according to the electoral law of the country, isn&#8217;t it?<\/strong><\/span><\/p>\n<p><span style=\"color: #000000;\">Spending more than what is allowed by law is a serious offence and constitutes an illegal practice under the Representation of the People Act (The Act). A guilty candidate is liable to pay a fine and will be ineligible to stand as a candidate, vote, or be registered as an elector.<\/span><\/p>\n<p><span style=\"color: #000000;\"><strong>* If the Electoral Commission or Electoral Supervisory Commission decides that these constitute serious violations, do they have to refer the matter to the Supreme Court for legal proceedings and enforcement of penalties?<\/strong><\/span><\/p>\n<p><span style=\"color: #000000;\">When an offence is committed, there must be a prosecution. It is for the Electoral Commission or the Electoral Supervisory Commission to decide on the appropriate course of action.<\/span><\/p>\n<p><span style=\"color: #000000;\"><strong>* However, Sections 74A and 74B of the Representation of the People Act provide for &#8220;relief&#8221; if the Court determines that the MPs&#8217; actions or omissions resulted from inadvertence, a reasonable cause, or a lack of bad faith. Given this provision, how do you expect the Supreme Court to respond to any potential application for relief from the six MPs?<\/strong><\/span><\/p>\n<p><span style=\"color: #000000;\">Well, if there is a motion for relief, the Supreme Court will have to examine the facts and circumstances under which the excess payments were declared. The judges will then make a decision. An election cannot be invalidated for the mere asking by the opponents of the candidates.<\/span><\/p>\n<p><span style=\"color: #000000;\"><strong>* Do you think the Court may reject the application for relief if the overspending appears to be a deliberate attempt to gain an unfair advantage in the election? <\/strong><\/span><\/p>\n<p><span style=\"color: #000000;\">Given that the excess expenses were almost insignificant and resulted from either inadvertence or negligence\u2014surely without any criminal intention\u2014it would be an exaggeration to conclude bad faith. Bad faith or criminal intention depends on the circumstances.<\/span><\/p>\n<p><span style=\"color: #000000;\"><strong>* Is it possible that the extent of the overspending by the candidates will also be considered by the Court?\u00a0 That is if the excess spending is minor, the Supreme Court might grant relief, especially if it did not significantly impact the fairness of the election?<\/strong><\/span><\/p>\n<p><span style=\"color: #000000;\">Of course. If the excess amount was minimal, the court is likely to show leniency. After all, how can a few hundred rupees unfairly impact an election?<\/span><\/p>\n<p><span style=\"color: #000000;\">However, it must be noted that expenses incurred on behalf of a candidate by political agents do not need to be declared in the candidate\u2019s return. This loophole creates a lack of transparency, as any amount spent by an agent remains opaque. A candidate is only guilty of illegal practice if such expenses were made with their consent.<\/span><\/p>\n<p><span style=\"color: #000000;\">This situation is absurd and undermines the credibility of electoral spending limits. After all, where would an agent get massive amounts to spend on a candidate if not from the candidate themselves?<\/span><\/p>\n<p><strong>* What if the Court decides that ignorance of the law is no excuse? Is this not a fundamental principle in legal systems worldwide, ensuring that individuals are held accountable for their actions, regardless of their knowledge or understanding of the law?<\/strong><\/p>\n<p>Ignorance of the law is no excuse. The candidates will not be stupid to invoke ignorance. Instead, they will rely on good faith and inadvertence, leaving it to the court to determine the outcome.<\/p>\n<p><strong>* However, one could also argue that the law is an ass &#8212; rigid, unreasonable, and sometimes lacking common sense. This is especially relevant given the widespread belief that most election candidates intentionally misreport or underreport their electoral expenses. What do you think?<\/strong><\/p>\n<p>This question touches on a more specific issue\u2014the unreasonably low spending limits imposed on candidates, which fail to reflect the reality of rising costs in an era of inflation. Justice Sachs, in his report on Electoral Reform, went so far as to describe this as condoning official lies.<\/p>\n<p><strong>* Should this incident spark a debate on electoral reforms in Mauritius, particularly regarding campaign finance rules and the enforcement of spending limits? What changes would you recommend?<\/strong><\/p>\n<p>There have been numerous debates with little to no result. The report by Justice Sachs, which addressed these very issues, has remained a dead letter. What, then, will another debate achieve?<\/p>\n<p><strong>* The Kistnen Papers case remains shrouded in uncertainty, with little recent information on the progress of the investigation. This case is particularly serious because, beyond electoral expenses, it is linked to allegations of corruption, fraud, and potentially even murder &#8212; raising grave concerns about political integrity and justice. What should we make of this case?<\/strong><\/p>\n<p>The allegations made under the previous regime have either not been properly investigated or were handled in an amateurish manner, seemingly to shield the former political masters. However, Prime Minister Navin Ramgoolam has now stated that this matter will be investigated. Let us hope that this leads to meaningful action.<\/p>\n<p><strong>* Ultimately, without decisive police and legal action and greater transparency, the Kistnen Papers case risks becoming another example of impunity in high-profile political scandals. The question remains: Will justice be served, or will silence prevail?<\/strong><\/p>\n<p>Silence prevails not only on the Kistnen Papers but also regarding the perpetrators of his murder. This has been the case due to the presence of police officers who owed their allegiance not to the State, but to the former political masters.
