{"id":38687,"date":"2023-10-20T18:16:32","date_gmt":"2023-10-20T14:16:32","guid":{"rendered":"http:\/\/www.mauritiustimes.com\/mt\/?p=38687"},"modified":"2023-10-27T18:04:40","modified_gmt":"2023-10-27T14:04:40","slug":"pre-determined-legal-outcomes","status":"publish","type":"post","link":"https:\/\/www.mauritiustimes.com\/mt\/pre-determined-legal-outcomes\/","title":{"rendered":"Pre-determined legal outcomes"},"content":{"rendered":"<p style=\"text-align: center;\"><span style=\"color: #ff0000;\"><u>Opinion<\/u><\/span><!--more--><\/p>\n<p><strong><span style=\"color: #000080;\">By Prakash Neerohoo<\/span><br \/>\n<\/strong><br \/>\n<span style=\"color: #000000;\">From an ideological perspective, I have always argued that legal outcomes are pre-ordained and pre-determined in a class society where privileged classes hold absolute political and economic power.<\/span><\/p>\n<p><span style=\"color: #000000;\">The king\u2019s law lords would never upset the rule of the monarchy, whether it is <em>de jure<\/em> there (UK) or <em>de facto<\/em> over here. It was naive for some people to expect a different outcome than what they heard on October 16th.<\/span><\/p>\n<p><span style=\"color: #000000;\">That speaks to their lack of political culture, their misunderstanding of the interdependence of political, economic and legal institutions in a capitalist society, and their lack of knowledge of the sociology of law. What is called respect for public institutions is actually acquiescence to the anti-democratic practices of such institutions.<\/span><\/p>\n<p><span style=\"color: #000000;\">In a class society, the legal system is the superstructure that upholds the arbitrary laws passed by Parliament in the name of separation of powers (which is doubtful). Higher courts lack judicial activism. When aggrieved parties get relief at a lower court thanks to maverick magistrates, the higher court overturns the ruling in order not to rock the boat.<\/span><\/p>\n<p><span style=\"color: #000000;\">Regulatory and investigative institutions twist facts and evidence to suit their political agenda and very often act <em>ultra vires<\/em> to their statutory mandate. In many cases, we see corrupt officials getting away with murder because they are power holders or close to power. In one particular area, namely contract law, we see that courts of justice are always upholding immoral or rigged contracts by relying on a literal interpretation of the law (just looking at the rights and obligations of parties). <\/span><\/p>\n<p><span style=\"color: #000000;\">Unless there is a political revolution to do away with <em>de facto<\/em> monarchy (like the French Revolution) and make radical constitutional changes, the whole system will continue to operate in an anti-democratic way against public interest, that is the people\u2019s interests. <\/span><\/p>\n<p><span style=\"color: #000000;\">Only dim-witted people or semi-intellectuals with no ability to think about fundamental systems are happy with predictable legal outcomes.
