Pr\u00e9texte\u00a0: la r\u00e9forme \u00e9lectorale avec comme motif principal la repr\u00e9sentation proportionnelle.<\/span><\/p>\n<p><span style=\"color: #000000;\">Sous cette couverture, \u2018Ti cr\u00e9tin\u2019 est redevenu \u2018Ti frer\u2019 du grand cr\u00e9tin. La population est abasourdie par ce soudain revirement et retournement de veste. Si le \u2018Ti frer\u2019 croit que le \u2018Gran frer\u2019 contractera une alliance avec son parti &#8212; apr\u00e8s cette rencontre &#8212; en vue des prochaines \u00e9lections g\u00e9n\u00e9rales, il restera un grand na\u00eff\u2026<\/span><\/p>\n<p><span style=\"color: #000000;\">Quand on parle de la r\u00e9forme \u00e9lectorale et surtout de repr\u00e9sentation proportionnelle, tout le monde sait que c\u2019est un syst\u00e8me vou\u00e9 \u00e0 l\u2019\u00e9chec. A Rodrigues, on a vu le bouleversement que cela a provoqu\u00e9. Dans le pays de r\u00e9f\u00e9rence, Trinidad et Tobago, la repr\u00e9sentation proportionnelle a apport\u00e9 un d\u00e9s\u00e9quilibre social plus qu\u2019une harmonie sociale. Dans aucune des grandes d\u00e9mocraties inspir\u00e9es par le style westminist\u00e9rien comme l\u2019Inde ou la Grande Bretagne, l\u2019on ne penserait \u00e0 introduire la repr\u00e9sentation proportionnelle. Alors pourquoi cet empressement du leader du MMM d\u2019aller de l\u2019avant avec cette r\u00e9forme\u00a0?<\/span><\/p>\n<p><span style=\"color: #000000;\">Est-ce que leader du MMM aurait un agenda cach\u00e9\u00a0? Depuis que le MMM est arriv\u00e9 au pouvoir en 1982, l\u2019une de ses premi\u00e8res actions a \u00e9t\u00e9 l\u2019abolition de la d\u00e9claration d\u2019appartenance communautaire lors des recensements de la population pour soi-disant lutter contre le communalisme. Or, depuis ce parti a toujours pr\u00e9sent\u00e9 tous ses candidats en fonction de leur profil ethnique, dont trois Musulmans au No. 3, trois Hindous dont un \u00ab\u00a0Vaish\u00a0\u00bb, un \u00ab\u00a0Rajput\u00a0\u00bb et un \u00ab\u00a0Ravived\u00a0\u00bb au No. 5 et ainsi de suite.<\/span><\/p>\n<p><span style=\"color: #000000;\">Dans le pass\u00e9, les grand tribuns travaillistes dont les Ramlallah, Ramnarain et autres Ramgoolam avaient lutt\u00e9 contre la repr\u00e9sentation proportionnelle afin d\u2019\u00e9viter toute balkanisation du peuple mauricien. Dans leur sagesse, ils avaient propos\u00e9 l\u2019introduction du syst\u00e8me de \u00ab\u00a0Best Loser\u00a0\u00bb pour prot\u00e9ger les minorit\u00e9s. Aujourd\u2019hui, ce syst\u00e8me existe toujours mais est quelque peu d\u00e9pass\u00e9 par l\u2019abolition de la d\u00e9claration d\u2019appartenance communautaire. Ce qui fausse cet exercice car la Commission \u00e9lectorale se base toujours sur les statistiques de la population d\u2019avant \u201982 pour d\u00e9terminer les \u00ab\u00a0Best Losers\u00a0\u00bb.<\/span><\/p>\n<p><span style=\"color: #000000;\">Cette abolition, suivie de la cr\u00e9ation des centres culturels et linguistiques qui ont pouss\u00e9 un peu comme des champignons dans le pays, d\u00e9montrent l\u2019agenda cach\u00e9 du MMM. Il suffit de fragmenter la population en morceaux culturels et linguistiques pour accentuer les clivages afin de mieux r\u00e9gner. Il est temps que l\u2019on arr\u00eate de traiter la population comme une bande de cr\u00e9tins\u00a0!<\/span><\/p>\n<p style=\"text-align: right;\"><span style=\"color: #000000;\"><strong><em>Suttyhudeo Tengur<br \/>\n<\/em><\/strong><em>Pr\u00e9sident &#8211; Government Hindi Teachers\u2019 Union <\/em><\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"color: #000000;\"><em>\u00a0<\/em>\u00a0<em>* * * <\/em><\/span><\/p>\n<h4 style=\"text-align: center;\"><span style=\"color: #000000;\"><strong>Senior Centres and Prison Services<\/strong><\/span><\/h4>\n<p><span style=\"color: #000000;\">I read some time back that 45% (or is it 65%?) of our local prison inmates go back to crime every now and then. Here\u2019s a twisted thought, and what a great idea!\u00a0Here is the way it should be: <\/span><br \/>\n<span style=\"color: #000000;\"><strong>Let&#8217;s put the seniors in jail and criminals in nursing homes.<\/strong> <\/span><br \/>\n<span style=\"color: #000000;\">This would correct two things at one go: Seniors would have access to showers, hobbies and walks.\u00a0They would receive unlimited free prescriptions, dental and medical treatment,\u00a0wheel chairs, etc.<\/span><br \/>\n<span style=\"color: #000000;\">They would receive\u00a0money instead of having to pay it out. They would have constant video monitoring so they would be helped immediately if they fell or needed\u00a0assistance.<\/span><br \/>\n<span style=\"color: #000000;\">Bedding would be washed\u00a0twice\u00a0a week, and all clothing would be ironed and returned to them.<\/span><br \/>\n<span style=\"color: #000000;\">A guard would check on them every 20 minutes. All meals and snacks would be brought to\u00a0them. They would have family visits in a suite built for that purpose.<\/span><br \/>\n<span style=\"color: #000000;\">They would have access to a library,\u00a0weight\/fitness room; spiritual counselling; a pool; and education plus free admission to in-house concerts by nationally recognized entertainment artists.<\/span><br \/>\n<span style=\"color: #000000;\">Simple clothing &#8212; i.e. shoes, slippers, pyjamas &#8212; plus legal aid would be free upon request.\u00a0<\/span><br \/>\n<span style=\"color: #000000;\">There would be private, secure rooms provided for all with an outdoor exercise yard complete with gardens.<\/span><br \/>\n<span style=\"color: #000000;\">Each\u00a0senior would have a PC, TV, phone and radio in their room\u00a0at no cost. They would receive daily phone calls.<\/span><br \/>\n<span style=\"color: #000000;\">There would be a board of directors to hear any complaints and local NGOs would fight for their rights and protection.<\/span><br \/>\n<span style=\"color: #000000;\">The guards would have a code of conduct to be strictly adhered to with lawyers available at no\u00a0charge, to protect the seniors and their families from abuse or neglect.<\/span><br \/>\n<span style=\"color: #000000;\">As for the criminals:<\/span><br \/>\n<span style=\"color: #000000;\">They would\u00a0receive\u00a0cold\u00a0food.<\/span><br \/>\n<span style=\"color: #000000;\">They would\u00a0be left alone and unsupervised.<\/span><br \/>\n<span style=\"color: #000000;\">They would\u00a0receive showers\u00a0once\u00a0a week.<\/span><br \/>\n<span style=\"color: #000000;\">They would live in tiny rooms, for which they would have to pay Rs 5000 per month.<\/span><br \/>\n<span style=\"color: #000000;\">They would have no hope of ever getting out.<\/span><\/p>\n<p><span style=\"color: #000000;\">Sounds like justice to me! What do you think?<\/span><\/p>\n<p style=\"text-align: right;\"><span style=\"color: #000000;\"><strong><em>Kamal<br \/>\n<\/em><\/strong><em>Curepipe<\/em><\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"color: #000000;\"><em>* * * <\/em><\/span><\/p>\n<h4 style=\"text-align: center;\"><span style=\"color: #000000;\"><strong>The Impact of Lord Woolf\u2019s Reforms on the<br \/>\nMauritian Judiciary<\/strong><\/span><\/h4>\n<p><span style=\"color: #000000;\">Lord Woolf claimed that the civil justice system has become excessively adversarial, slow, complex and expensive costs had become disproportionate to the issues involved in litigation and that there was undue complexity of law procedure, and uncertainty about how much time and money would be required.<\/span><\/p>\n<p><span style=\"color: #000000;\">His proposals aim at cutting delays, reducing expenses and simplifying the process of litigation. Lord Woolf sought to encourage parties to explore alternatives to the resolution of dispute by a court. He also advocated a short timetable for cases to reach the court and for the length of trials.<\/span><\/p>\n<p><span style=\"color: #000000;\">Taken in the local context, there is no doubt that our judiciary has implemented some of Lord Woolf\u2019s reforms. What is the current position regarding the backlog of civil cases pending at Supreme Court, Civil division of the Intermediate Court and the Industrial Court?<\/span><\/p>\n<p><span style=\"color: #000000;\">Has litigation become less complex? Should the timetable of litigation become shorter and more certain? There is still much scope for improvement. Although our judiciary has admittedly introduced judicial case management, yet certainly we should be more concerned with managing the business of the courts more efficiently as strict timetabling would reduce delay and uncertainty in progressing. Hands-on judicial case management should reduce delay and the scope of unfairness.<\/span><\/p>\n<p><span style=\"color: #000000;\">Certainly we should place great faith in the impact of new technology. Lord Woolf argued that it was certainly more practical to exert greater case management than in the past because of advances of technology which make it possible. Courts are already using information Technology to monitor the process of litigation. Of course there should be video and telephone conferencing facilities. Some courts like Employment Relations Tribunal are already providing information technology facilities.<\/span><\/p>\n<p><span style=\"color: #000000;\">In the absence of a credible survey among litigants and lawyers alike, it will be difficult to assess whether some particular courts are managing their cases better than other court divisions. Cheung Shan Yan, le 27 f\u00e9vrier 1945 devant le notaire Me Richard de Chazal pour la somme de Rs 49,000.<\/span><\/p>\n<p><span style=\"color: #000000;\">Le titre de propri\u00e9t\u00e9 Reg. C No. 856 (Trans Vol: 488 No. 492 pages 1-4) stipule clairement \u00ab\u00a0que les vendeurs reconnaissent avoir re\u00e7u et touch\u00e9 du gouvernement de la R\u00e9publique chinoise par les mains de Monsieur Cheung Shan Yan\u00a0\u00bb ce terrain. De facto, ces 13 personnes soussign\u00e9es \u00e9taient des \u00ab\u00a0trustees\u00a0\u00bb nomm\u00e9s par le Consul d\u2019alors.<\/span><\/p>\n<p><span style=\"color: #000000;\">Il est grand temps de rendre \u00e0 C\u00e9sar ce qui appartient \u00e0 C\u00e9sar. Maurice pr\u00f4ne une politique de \u2018Only One China\u2019 et, par cons\u00e9quent, il doit \u00eatre restitu\u00e9 au gouvernement de la R\u00e9publique Populaire de Chine par le biais de son Ambassade \u00e0 Belle Rose. Nous avons d\u00e9j\u00e0 port\u00e9 l\u2019affaire devant La Commission Justice et V\u00e9rit\u00e9. Et nous demandons au Registrar General de faire le n\u00e9cessaire afin de restituer ce terrain \u00e0 son propri\u00e9taire l\u00e9gitime.<\/span><\/p>\n<p><span style=\"color: #000000;\">C\u2019est un patrimoine appartenant \u00e0 la communaut\u00e9 sino-mauricienne.
